Sumner Redstone describes Manuel  Herzer who is suing to challenge his mental competency as  “f– ing bitch,” during the mental competency trial this week, repeating it several times during a deposition.

On Friday, they got their first insight through the transcript of a videotaped deposition of Mr. Redstone that aired in the first day of the trial.
In his deposition, the media mogul struggled to respond to questions with the help of an interpreter, who asked him repeatedly to slow down and speak louder. At one point, she asked Mr. Redstone to swallow when he was having trouble. And on various occasions, he tried but failed to spell out words as responses.

Mr. Redstone came across clearly in the transcript. Asked by Ms. Herzer’s attorney at the start of the interview “Who is Manuela Herzer?,” Mr. Redstone replied “Manuela is a f–ing bitch,” according to the transcript. He repeated that description multiple times, including in answer to a question on why he evicted her from his home.

Asked if Ms. Herzer stole money from him, he answered “Yes.” And when asked by his own attorney, “Who do you want to make your health care decisions?” Mr. Redstone replied, “Shar – Shari.” Shari Redstone is his daughter.

After viewing the videotape, Judge David Cowan of Los Angeles Superior Court indicated he felt Mr. Redstone made his preferences clear. Later in the day, he told the attorneys in the courtroom that he would consider the defense’s request to dismiss the case, and make a decision on Sunday.
The California lawsuit centers on a claim by Manuela Herzer, Mr. Redstone’s former companion and housemate, that he was incompetent when he evicted her last fall. He also removed her as his health-care agent in the event he became incapacitated, and cut her out of his will.

Mr. O’Donnell’s opening remarks painted Ms. Redstone as the mastermind of Ms. Herzer’s ouster, calling it a “palace coup…financed by his daughter Shari.” He argued that Ms. Redstone “needed to get rid of Manuela by any means” because “she was a tough barrier between her and her father’s money and power.”

Ms. Redstone – The statements “are total fiction with no factual basis.” and has alleged that Ms. Herzer blocked her from seeing her father, a claim Ms. Herzer denied. Both women were in court on Friday, with Ms. Redstone shaking her head “no” at points during the proceeding.
In his opening remarks, Mr. Redstone’s lawyer, Robert Klieger, called his client a “stubborn, strong-willed, obsessive” person who “won’t take ‘no’ for an answer” and “does not tolerate lies.”

Mr. Redstone’s harsh descriptions of Ms. Herzer were reminiscent of Mr. Redstone’s hard-nosed business dealings of the past several decades, during which he was known to be tough, litigious and outspoken.

Mr. Klieger alleged that Ms. Herzer lied to keep him away from contact with two women he cared about, ex-girlfriend Sydney Holland and longtime friend Terry Holbrook. Mr. Redstone “obsesses over women,” Mr. Klieger said. “He hates to be alone.”

As such, his decision to throw Ms. Herzer out of his house and remove her as his health-care agent “was not an irrational change,” Mr. Klieger said. “The evidence will show that he did in fact have the capacity to make that decision.”

Shari already holds 20 percent ownership and, upon the death or incapacitation of Sumner, his 80 percent interest in Viacom and CBS is lorded over by a trust for the benefit of his five grandchildren. Three of whom, Shari’s children, possess a more significant stake and say through their mother’s existing 20 percent ownership. Simple math: 16 percent (Kimberlee Korff Ostheimer) + 16 percent (Brandon Korff) + 16 percent (Tyler Korff) + 20 percent (Shari Korff Redstone) = 68 percent.
